A.1 Welcome to The Playpen Enterprises LLC ("The Playpen," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our platform and services (collectively, the "Services") as an event attendee ("you" or "Attendee"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

B.1 The Playpen provides a platform that enables independent event organizers ("Organizers") to list, promote, and manage events.

B.2 We do not create, organize, or own the events listed on our platform. Organizers are solely responsible for the events they list, including compliance with applicable laws and the delivery of event services.

C.1 To access certain features of our Services, you may need to create an account.

C.2 You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.

C.3 You are responsible for safeguarding your account credentials and for all activities that occur under your account.

D.1 Organizers are responsible for the accuracy of their event listings.

D.2 When you purchase a ticket or register for an event, you enter into a contract directly with the Organizer.

D.3 The Playpen is not a party to this contract and does not guarantee the quality, safety, or legality of events.

E.1 Payments for events are processed through third-party payment processors, such as Stripe.

E.2 The Playpen may charge service fees for the use of our platform, which will be disclosed at the time of purchase.

E.3 All fees are non-refundable unless otherwise stated.

F.1 Refund policies are set by Organizers.

F.2 If you wish to request a refund, you must contact the Organizer directly.

F.3 The Playpen is not responsible for issuing refunds and has no control over Organizer refund policies.

G.1 Attendance at events may carry inherent risks, including but not limited to personal injury, illness, or property damage.

G.2 By attending an event, you voluntarily assume all such risks and agree that The Playpen is not responsible for any resulting harm.

G.3 If you purchase a ticket or register on behalf of another individual, you represent and warrant that you have the authority to bind that individual to these Terms. You further agree that such individual shall be deemed to have accepted these Terms, and you assume full responsibility for informing them of all terms, conditions, policies, and risks described herein. You acknowledge that you are solely responsible for any claims, liabilities, damages, or losses arising from their attendance or participation.

H.1 You agree not to:

• H.1.1 Violate any applicable laws or regulations.
• H.1.2 Use our Services for any unlawful or fraudulent purpose.
• H.1.3 Interfere with or disrupt the integrity or performance of our Services.
• H.1.4 Attempt to gain unauthorized access to our systems or networks.

I.1 All content and materials on our platform, including trademarks, logos, and service marks, are the property of The Playpen or its licensors.

I.2 You may not use, reproduce, or distribute any content without our prior written consent.

J.1 Your use of our Services is subject to our Privacy Policy, which outlines how we collect, use, and disclose your personal information.

J.2 By using our Services, you consent to our data practices as described in the Privacy Policy.

K.1 Our Services are provided on an "as is" and "as available" basis.

K.2 We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

K.3 We do not guarantee that our Services will be uninterrupted or error-free.

L.1 To the maximum extent permitted by law, The Playpen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of our Services.

M.1 You agree to indemnify and hold harmless The Playpen, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of our Services or violation of these Terms.

N.1 We may terminate or suspend your access to our Services at any time, with or without cause or notice.

N.2 Upon termination, your right to use our Services will immediately cease.

O.1 These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of law principles.

O.2 Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in Chicago, Illinois, in accordance with the rules of the American Arbitration Association.

O.3 Class Action Waiver: You agree that any claims or disputes between you and The Playpen must be resolved individually and may not be consolidated with any claims of any other party. You further agree not to participate in any class action, class arbitration, or other representative proceeding against The Playpen. By agreeing to these Terms, you waive any right to a jury trial and to participate in a class action or class-wide arbitration.

P.1 We may update these Terms from time to time.

P.2 We will notify you of any material changes by posting the new Terms on our platform.

P.3 Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
