By accessing or using the services provided by The Playpen Enterprises LLC ("The Playpen", "we", "us", "our") via ThePlaypen.com or the Playpen Chicago mobile application (collectively, the "Platform"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you disagree with these Terms, you must not access or use our services.

The Playpen provides a platform solely for facilitating communication and transactions between event organizers ("Organizers") and consumers attending events ("Consumers"). We do not create, organize, or host events, nor do we control the content, quality, legality, or safety of events listed on our Platform. Organizers are solely responsible for their events and compliance with all applicable laws, rules, and regulations.

To use certain features, you must create an account and provide accurate and updated information. You are responsible for all activities under your account and maintaining the confidentiality of your credentials.

Organizers are exclusively responsible for event details, ticket availability, pricing, refund policies, compliance with applicable laws, obtaining necessary permits and licenses, and delivering the event as advertised.

D.1 Event Participant Responsibility: It is the full responsibility of event participants to vet events for compliance with local ordinances, and state and federal laws. The Playpen Enterprises LLC is not responsible for any claims, losses, legal disputes, or damages resulting from participating in an event that violates any local, state, or federal law.

D.2 Tax Responsibility: Organizers are responsible for charging applicable local and state taxes on ticket sales and remitting these taxes to the respective jurisdictions.

Payments for paid events are processed through Stripe Connect on the Platform. The Organizer is the merchant of record for ticket sales, with payment processed as a Direct Charge on the Organizer's Connected Account. The Playpen facilitates this processing as the Platform but is not the merchant of record for ticket sales.

The Playpen may charge fees to Organizers for listing events or accessing premium features. Refund policies are determined by Organizers. Consumers must contact Organizers directly for refund requests; The Playpen is not responsible for refunds.

F.1 Nonrefundable Processing Fee: The Playpen Enterprises LLC will charge a nonrefundable fee to cover the costs of processing the registration. This fee is nonrefundable under any circumstances, including cancellations or refunds from either The Playpen Enterprises LLC or the event Organizer.

F.2 Refunds for Event Cancellation or Postponement: Individual refunds and mass refunds due to event cancellation or postponement are at the sole discretion of the Event Organizer and subject to the refund and event cancellation policy posted by the Event Organizer. By purchasing a ticket to the event, participants agree not to contact The Playpen Enterprises LLC for refunds or event information, nor to bring any claim for refunds against The Playpen Enterprises LLC.

We handle personal information according to our Privacy Policy. Organizers must comply with data protection laws regarding information obtained from Consumers.

Users must use the Platform lawfully and respectfully. Prohibited actions include posting false information, infringing intellectual property rights, transmitting harmful content, and disrupting service functionality.

All Platform content (excluding user-generated content) is owned by or licensed to The Playpen and is protected by intellectual property laws. Users must not use, reproduce, or distribute Platform content without explicit permission.

The Playpen is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from Platform usage, event attendance, or interactions between Organizers and Consumers.

You agree to indemnify and hold harmless The Playpen from any claims, losses, or damages arising from your use of the Platform, violation of these Terms, or disputes with other users.

We reserve the right to suspend or terminate access to the Platform for violations of these Terms, misuse of services, or at our discretion. Users can terminate by closing their accounts.

All disputes arising under these Terms shall be resolved through binding arbitration in Illinois, except small claims cases. You waive any right to participate in class or collective actions.

These Terms are governed by Illinois law. Any disputes not subject to arbitration shall be settled in the state or federal courts located in Illinois.
